Terms and Conditions

Effective Date: May 1st, 2025

Please review these Terms of Use carefully, along with any other terms or policies referenced herein (collectively, the “Terms”). These Terms govern your access to and use of www.swissgallery.ae (the “Website”) and any services made available through it. By using the Website or placing an Order, you agree to be bound by the latest version of these Terms posted at the time of your use or purchase.

We may amend these Terms at any time without notice by posting an updated version on the Website. You are responsible for checking the Terms periodically. If a change in law requires us to amend these Terms after you have placed an Order but before it has been fulfilled, that change will apply to your Order. Otherwise, the version in effect at the time of your Order will apply.

If you do not agree to these Terms, you should not use the Website or place any Orders.

Account Registration

You may use the Website as a guest or register an account. It is your responsibility to ensure that all personal and payment details provided are accurate and up to date. You must keep your account credentials secure and confidential. We are not responsible for losses resulting from unauthorized use of your account.

By registering or placing an Order, you confirm that the information you provide is yours, is accurate in all respects, and that you meet the eligibility criteria described in these Terms.

Privacy and Cookies

Please refer to our Privacy Policy for details on how we collect, use, and safeguard your personal information, including our use of cookies and tracking technologies.

Orders

By placing an Order, you agree to purchase the item(s) as described, at the listed price, including any applicable taxes, duties, and delivery fees. Orders are subject to acceptance. We reserve the right to refuse any Order at our sole discretion, including cases of suspected fraud, inability to verify payment, ineligibility, or stock unavailability.

Items in your cart are not reserved until your Order is paid for. Orders are not confirmed until you receive a dispatch notification.

Payment

We accept Visa, Mastercard, American Express, Apple Pay, and other payment methods listed at checkout. You warrant that you are authorized to use the selected payment method.

We may request identification or take other measures to confirm payment authorization. We reserve the right to cancel or restrict payment access where fraudulent or suspicious activity is detected.

Pricing and Currency

Prices are displayed in AED by default and may also be viewed in other currencies using the Website’s currency switcher. Prices exclude applicable delivery charges, duties, and taxes unless otherwise stated.

If you pay using a card in a different currency, your provider’s exchange rate and fees will apply. We reserve the right to correct any pricing errors and to cancel or amend Orders affected by such errors.

Shipping and Delivery

Orders are shipped from our facility in the United Arab Emirates. Estimated delivery times are displayed at checkout and are provided for reference only. Delivery timelines may be affected by customs clearance, holidays, high-demand periods, or unforeseen circumstances.

If we have not shipped your Order within sixty (60) calendar days from the date of purchase, and the delay is not due to your actions or external restrictions (such as customs or incorrect address), we will issue a full refund.

If delivery is refused or not accepted at the address provided, the goods will be held in storage free of charge for a period of up to thirty (30) days. If no revised delivery arrangement is confirmed within that timeframe, we reserve the right to cancel the Order, retain the goods, and retain all monies paid, without further obligation.

General Delivery Conditions

We are not responsible for delivery delays or failures caused by factors outside our reasonable control, including but not limited to: incorrect or incomplete delivery information, remote or restricted locations, carrier issues, customs processing, or force majeure events.

Additional delivery charges may apply for high-risk or remote areas. You will be notified of any such charges prior to dispatch. Delivery is considered complete when the Order has been delivered to the address provided at checkout or marked as delivered by the carrier.

Trade Terms

Orders are shipped under Incoterm CPT (Carriage Paid To). We cover transport costs until the shipment is handed over to the carrier. Risk in the goods transfers to you at that point.

Refunds, Returns and Exchanges

Please refer to our Returns and Refunds Policy for information on return eligibility, required conditions, and the procedure for requesting a return or exchange.

Cancellation

All Orders are final once placed. We do not allow cancellations or modifications after an Order has been processed. Please review your Order carefully before confirming your purchase.

Title and Risk

Title passes to you upon full payment and delivery. Risk in the items passes upon delivery to the address provided in your Order.

Intellectual Property

All content on the Website — including text, images, graphics, videos, logos, code, and layout — is the property of its respective owners or used with assumed fair commercial usage and may be protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, reproduce, publish, or commercially exploit any content without prior written permission. If you believe your intellectual property is used improperly, please contact info@swissgallery.ae.

Descriptions

We make every effort to ensure the accuracy of product information. However, colors and finishes may vary depending on screen settings and production differences. All measurements and dimensions provided are approximate.

User-Generated Content

By submitting reviews or other content, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content for commercial purposes. We reserve the right to remove any submitted content at our discretion.

Third Party Sites

The Website may include links to third-party websites or services. We do not control or endorse third-party content and are not responsible for their availability, accuracy, or practices. Use of such websites is at your own risk.

Promotions and Discounts

Promotions and discount codes are subject to availability and may be withdrawn at any time. Terms applicable to specific offers will be communicated where relevant.

Force Majeure

We are not liable for any delay or failure in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, customs delays, transportation disruptions, or technical failures.

Disclaimer of Warranties

The Website, its content, and all goods and services provided through it are offered “as is” and “as available,” without warranties of any kind. We disclaim all implied warranties, including fitness for a particular purpose, merchantability, and non-infringement, to the fullest extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability in respect of any claim shall not exceed the total amount paid for the affected Order.

Indemnity

You agree to defend, indemnify, and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Website, violation of these Terms, or breach of applicable law.

Entire Agreement

These Terms constitute the entire agreement between you and us regarding your use of the Website and supersede all prior agreements or understandings.

No Agency

Nothing in these Terms shall be construed to create a partnership, agency, or joint venture between the parties.

Assignment

We may assign or transfer our rights and obligations under these Terms without notice. You may not assign your rights without our prior written consent.

No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that or any other right.

Illegality

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.

Language

These Terms are published in English. If translated, the English version shall prevail in the event of inconsistencies or disputes.

Legal Disputes and Governing Law

These Terms and related transactions are governed by the federal laws of the United Arab Emirates.

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration. Before initiating arbitration, the initiating party must provide at least sixty (60) days' advance written notice and attempt informal resolution. Arbitration will be conducted on an individual basis only. Class actions and representative proceedings are not permitted.
